Why Tier-3 skill for Spidey is not available in IW extreme mode?

I have him T3 BDW.

All characters are set to tier 2 level 60 in legendary battles. What affects them is your ISOs, custom gear, uniform level, cards, and skill levels. That’s whether you have that character at rank 1 level one to tier 3
